§ 1Scope & provider

These general terms and conditions apply to all orders you place via the website wompfel.com. The provider and your contractual partner is:

Further details in thelegal notice. A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 of the German Civil Code).

§ 2Conclusion of contract

The presentation of Wompfel and accessories on the website does not constitute a legally binding offer, but a non-binding invitation to place an order.

By clicking the order/payment button you submit a binding offer to purchase. Payment is processed via our payment service provider Stripe; you will be redirected to a secure payment page hosted by Stripe.

The contract of sale is concluded when we accept your order — at the latest upon dispatch of the goods or an express order confirmation. An automatic acknowledgement of receipt or payment does not yet constitute acceptance of the contract.

Note: on the site we speak of “adopting”. In law this is an ordinary contract of sale.

§ 3Prices & shipping costs

All prices are final prices and include statutory VAT. Shipping costs are charged in addition to the stated product price.

Shipping costs within Germany are6,49 €per shipment. We currently offer deliveries to other countries on request only; any differing shipping costs will be communicated before the contract is concluded.

§ 4Payment

Payment is made via the payment service provider Stripe (e.g. credit card and other payment methods offered by Stripe). The purchase price falls due immediately upon conclusion of the contract. Details of data processing by Stripe can be found in ourprivacy policy.

§ 5Delivery

Delivery is insured and carefully packaged. Within Germany, delivery normally takes 3–5 working days after the contract is concluded. Made-to-order and individual custom Wompfel are produced by separate arrangement; we will inform you of the expected delivery time at that point.

Every Wompfel is a one-off or part of a limited edition. If an ordered item is unexpectedly unavailable, we will inform you without delay and refund any payments already made immediately.

§ 6Retention of title

The goods delivered remain our property until payment has been made in full.

§ 7Right of withdrawal

As a consumer you generally have a fourteen-day right of withdrawal for distance contracts. You will find the details, the instructions and the model withdrawal form in ourwithdrawal instructions.

Exception:The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer's personal requirements (§ 312g (2) no. 1 of the German Civil Code). This applies in particular tocustom Wompfel and Wompfel made individually to order or to measure.

§ 8Warranty & condition

Statutory liability for defects applies. Wompfel are collector's figures, made in Germany and finished by hand. Visible textures, small irregularities, slight variations in colour and shape and the hand-finished character are expressly intended and do not constitute a defect; they are the agreed condition of each unique piece.

§ 9Liability

We are liable without limitation for damage arising from injury to life, body or health, for damage based on intent or gross negligence, and under the German Product Liability Act. In the case of slightly negligent breach of material contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical of the contract. Liability is otherwise excluded.

§ 10Product notice

Wompfel are collector's figures, made in Germany and finished by hand. They arenot toysand are not suitable for children under 14. They may have small, fine or delicate parts and belong on shelves, desks and in display cases.

§ 11Consumer dispute resolution

Pursuant to § 36 VSBG we point out that we areneither obliged nor willingto take part in dispute resolution proceedings before a consumer arbitration board.

The former EU online dispute resolution platform (ODR platform) was discontinued on 20 July 2025 and is no longer available.

§ 12Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of the country of your habitual residence remain unaffected. The contract language is German. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
